All that is necessary for an understanding of the case is important and required.<\/p>\n<p>The report must go beyond the discussion of the problem posed in the textbook, to achieve a superior grade. Do research outside the textbook- this must include research outside the case citation, do research on the parties and circumstances of the case itself and incorporate some visual modality as a part of the case analysis. Something about one of the parties, as well as some background contained in the legal opinion. Doing significant research outside the textbook is essential.<\/p>\n<p>Utilize the case format below.<\/p>\n<p>Case Analysis Format<\/p>\n<p>Read and understand the case or question assigned.<\/p>\n<p>Case: United States v. Gray<\/p>\n<p>Show your Analysis and Reasoning and make it clear you understand the material. Be sure to incorporate the concepts of the chapter we are studying to show your reasoning.<\/p>\n<p>Dedicate at least one heading to each following outline topic:<\/p>\n<p>Parties [Identify the plaintiff and the defendant]<\/p>\n<p>Facts [Summarize only those facts critical to the outcome of the case]<\/p>\n<p>Procedure [Who brought the appeal? What was the outcome in the lower court(s)?]<\/p>\n<p>Issue [Note the central question or questions on which the case turns]<\/p>\n<p>Explain the applicable law(s). Use the textbook here. The law should come from the same chapter as the case. Be sure to use citations from the textbook including page numbers.<\/p>\n<p>Holding [How did the court resolve the issue(s)? Who won?]<\/p>\n<p>Reasoning [Explain the logic that supported the court\u2019s decision]<\/p>\n<p>Do significant research outside of the book and demonstrate that you have in an obvious way. This refers to research beyond the legal research. This involves something about the parties or other interesting related area.<\/p>\n<p>Show something you have discovered about the case, parties or other important element from your own research. Be sure this is obvious and adds value beyond the legal reasoning of the case.<\/p>\n<p>***Dedicate 1 heading to each of the case question(s) immediately following the case, Be sure to restate and fully answer the questions<\/p>\n<p>Questions: CRITICAL THINKING ABOUT THE LAW<\/p>\n<p>The defendant in this case seems to misunderstand the law. His contention is that his offer to bribe is an absurdity and that Patti should have recognized it as such. His logic is that there can be no fraud unless the person who is allegedly being helped by the fraud reasonably believes the promised act will occur. In other words, the more outrageous the promise, the more the person charged with fraud can escape liability. The court in this case makes it clear that it is the act of the person initiating the fraud that is the key to the offense, not the response of the person being defrauded.<\/p>\n<p>1. Does the rule of law in mail fraud cases require any particular action or belief on the part of the person being defrauded?<\/p>\n<p>Clue: Study the quote in the next-to-last paragraph of the decision.<\/p>\n<p>2. What ethical norm is being emphasized by the rule of law with respect to mail fraud?<\/p>\n<p>Clue: Look back at the list of alternative ethical norms and make a determination about which of them is being advanced by the rule of law as it applies to mail fraud.<\/p>\n<p>Wrap up with a Conclusion. This should summarize the key aspects of the decision and your recommendations on the court\u2019s ruling.<\/p>\n<p>Include citations and a reference page with your sources.
