{"id":2999,"date":"2020-11-06T07:24:45","date_gmt":"2020-11-06T07:24:45","guid":{"rendered":"http:\/\/onlineclassesguru.com\/?p=2999"},"modified":"2020-11-06T07:24:45","modified_gmt":"2020-11-06T07:24:45","slug":"hooters-restaurants-case-study","status":"publish","type":"post","link":"https:\/\/onlineclassesguru.com\/index.php\/2020\/11\/06\/hooters-restaurants-case-study\/","title":{"rendered":"Hooters Restaurants Case Study"},"content":{"rendered":"<style type=\"text\/css\"><\/style><div>\n<p>Case Study<\/p>\n<p>Hooters\u00a0Restaurants<\/p>\n<p>Background\u00a0Information\u00a0 Hooters\u00a0restaurants\u00a0are\u00a0known\u00a0for\u00a0spicy\u00a0chicken\u00a0wings,\u00a0the\u00a0Owl\u00a0mascot\u00a0(i.e.,\u00a0\u201cHooters\u201d)\u00a0and\u00a0Hooters\u2019\u00a0 girls,\u00a0dressed\u00a0in,\u00a0as\u00a0the\u00a0company\u00a0describes\u00a0it,\u00a0\u201cwhite\u00a0Hooters\u00a0tank\u00a0top,\u00a0orange\u00a0shorts,\u00a0suntan\u00a0hose,\u00a0 white\u00a0socks,\u00a0solid\u00a0white\u00a0shoes,\u00a0brown\u00a0Hooters\u00a0pouch,\u00a0name\u2010tag\u00a0and\u00a0of\u00a0course\u00a0&#8230;\u00a0a\u00a0smile!\u201d\u00a0Hooters\u00a0only\u00a0 hires\u00a0female\u00a0servers\u00a0and\u00a0readily\u00a0admits\u00a0that\u00a0\u201cthe\u00a0element\u00a0of\u00a0female\u00a0sex\u00a0appeal\u201d\u00a0is\u00a0part\u00a0of\u00a0its\u00a0business,\u00a0 but\u00a0no\u00a0more\u00a0so,\u00a0it\u00a0argues,\u00a0than\u00a0the\u00a0\u201csocially\u00a0acceptable\u201d\u00a0Dallas\u00a0Cowboy\u00a0Cheerleaders,\u00a0Sports\u00a0Illustrated\u00a0 swimsuit\u00a0models,\u00a0or\u00a0Radio\u00a0City\u00a0Rockettes.\u00a0Hooters\u00a0states,<\/p>\n<p>The\u00a0\u2018nearly\u00a0world\u00a0famous\u2019\u00a0Hooters\u00a0Girls\u00a0are\u00a0the\u00a0cornerstone\u00a0of\u00a0the\u00a0Hooters\u00a0concept,\u00a0and\u00a0as\u00a0part\u00a0 of\u00a0their\u00a0job,\u00a0these\u00a0all\u2010American\u00a0cheerleaders\u00a0make\u00a0promotional\u00a0and\u00a0charitable\u00a0appearances\u00a0in\u00a0 their\u00a0respective\u00a0communities.\u00a0Hooters\u00a0hires\u00a0women\u00a0who\u00a0best\u00a0fit\u00a0the\u00a0image\u00a0of\u00a0a\u00a0Hooters\u00a0Girl\u00a0to\u00a0 work\u00a0in\u00a0this\u00a0capacity.<\/p>\n<p>Hooters provides detailed guidelines on its Web site about hair, eyes, skin, makeup, and exercise.\u00a0 Consistent with maintaining the image of a Hooters Girl, all of its female wait staff must attend image\u00a0 classes and pass an image quiz.\u00a0 \u00a0 Current Issue\u00a0 Hooters is being sued for discrimination by two waitresses from Roseville, Michigan, Cassandra Smith\u00a0 and Leeanne Convery. Smith received positive performance evaluations and was promoted to shift\u00a0 supervisor. But at her last evaluation, the 5&#8217;8&#8243; Smith says she was advised to lose weight and join a gym,\u00a0 despite dropping from 145 pounds, when hired, to her current 132.5 pounds. She says she was given 30\u00a0 days to lose more weight, and when she didn\u2019t, was fired. Says Smith, \u201cI had these two women from\u00a0 [Hooters headquarters in] Atlanta telling me I had 30 days to make an improvement, and I didn\u2019t know\u00a0 what I\u2019m supposed to improve. I was proud of myself, working out the last months, losing 10 pounds to\u00a0 get ready for my summer body. For that (phone call) to happen, it was almost a slap in the face.\u201d\u00a0 Convery, who is 4&#8217;11&#8221; and weighs 115 pounds, says she was also placed on weight probation and then\u00a0 fired, despite losing 15 lbs.\u00a0 \u00a0 Hooters Response\u00a0 In a written statement, Hooters said, \u201cNo employee in Michigan has been asked to lose weight and \u2026\u00a0 the company does not enforce any weight requirement.\u201d Company spokesperson Mike McNeil said,\u00a0 \u201cWe never mentioned weight. We never mentioned pounds. We never mentioned scales.\u201d But, he said,\u00a0 \u201cWe have an image to uphold. We\u2019ve been upholding it for 27 years. Hopefully, we&#8217;ll be doing it for\u00a0 another 27 years.\u201d Moreover, he said, \u201cYou\u2019re hired based on the image you have when you walk\u00a0 through the door.\u201d\u00a0 \u00a0 Additional Information\u00a0 Discrimination is treating people differently in hiring, firing, promotion, training, and compensation\u00a0 decisions because of nonperformance related criteria.\u00a0\u00a0For example, age discrimination is treating\u00a0 people differently because of their age.\u00a0\u00a0Age discrimination typically occurs when older workers are fired\u00a0 because of their age, or not hired, promoted, trained, or paid because of their age, rather than their\u00a0 potential or performance.\u00a0\u00a0The chapter discusses age, sex, race and ethnicity, and disability\u2010based discrimination\u00a0in\u00a0detail.\u00a0\u00a0Despite\u00a0good\u00a0efforts\u00a0and\u00a0intentions,\u00a0these\u00a0kinds\u00a0of\u00a0discrimination\u00a0still\u00a0occur\u00a0in\u00a0 workplaces,\u00a0but\u00a0to\u00a0a\u00a0lesser\u00a0degree\u00a0than\u00a0in\u00a0the\u00a0past.<\/p>\n<\/div>\n<div>\n<p>Federal\u00a0law,\u00a0based\u00a0on\u00a0Title\u00a0VII\u00a0of\u00a0the\u00a01964\u00a0Civil\u00a0Rights\u00a0Act,\u00a0says\u00a0that\u00a0it\u00a0is\u00a0not\u00a0unlawful\u00a0to\u00a0hire\u00a0and\u00a0employ\u00a0 someone\u00a0on\u00a0the\u00a0basis\u00a0of\u00a0sex,\u00a0religion,\u00a0or\u00a0national\u00a0origin.\u00a0\u00a0Notice,\u00a0however,\u00a0that\u00a0Title\u00a0VII\u00a0doesn\u2019t\u00a0say\u00a0 was\u00a0terminated\u00a0after\u00a0only\u00a0one\u00a0day.\u00a0The\u00a0recruiter\u00a0told\u00a0me\u00a0the\u00a0owner\u00a0said\u00a0he\u00a0didn&#8217;t\u00a0like\u00a0me\u00a0because\u00a0I\u00a0was\u00a0 overweight\u00a0and\u00a0had\u00a0large\u00a0breasts.\u00a0A\u00a0smaller\u00a0woman\u00a0with\u00a0less\u00a0experience\u00a0was\u00a0hired\u00a0to\u00a0replace\u00a0me.\u00a0Can\u00a0I\u00a0 fight\u00a0this?\u201d\u00a0\u00a0Attorney\u00a0Thomas\u00a0Mitchell,\u00a0who\u00a0was\u00a0consulted\u00a0by\u00a0the\u00a0columnist,\u00a0said,\u00a0\u201cWhat\u00a0happened\u00a0is\u00a0 wrong\u00a0and\u00a0unfair,\u00a0but\u00a0it&#8217;s\u00a0really\u00a0hard\u00a0to\u00a0persuade\u00a0a\u00a0court\u00a0that\u00a0it&#8217;s\u00a0illegal\u00a0under\u00a0that\u00a0context\u00a0because\u00a0the\u00a0 employer\u00a0didn&#8217;t\u00a0replace\u00a0you\u00a0with\u00a0a\u00a0male.\u201d\u00a0Mitchell\u00a0is\u00a0indicating\u00a0two\u00a0things\u00a0here.\u00a0First,\u00a0firing\u00a0this\u00a0woman\u00a0 because\u00a0of\u00a0her\u00a0weight\u00a0was\u00a0wrong,\u00a0but\u00a0it\u00a0wasn\u2019t\u00a0illegal\u00a0because\u00a0weight\u00a0is\u00a0not\u00a0covered\u00a0under\u00a0federal\u00a0law\u00a0 employment\u00a0decisions?\u00a0\u00a0Indeed,\u00a0Michigan\u00a0is\u00a0the\u00a0only\u00a0state\u00a0that\u00a0does.\u00a0\u00a0In\u00a01976,\u00a0Michigan\u00a0passed\u00a0the\u00a0 Elliott\u2010Larsen\u00a0Civil\u00a0Rights\u00a0Act\u00a0which\u00a0protects\u00a0rights\u00a0passed\u00a0on\u00a0religion,\u00a0race,\u00a0color,\u00a0national\u00a0origin,\u00a0age,\u00a0 sex,\u00a0height,\u00a0weight,\u00a0familial\u00a0status,\u00a0or\u00a0marital\u00a0status.\u00a0\u00a0More\u00a0specifically,\u00a0Michigan\u00a0employers\u00a0are\u00a0 prohibited\u00a0from\u00a0any\u00a0of\u00a0the\u00a0following:\u00a0To\u00a0fail\u00a0or\u00a0refuse\u00a0to\u00a0hire\u00a0or\u00a0recruit,\u00a0discharge,\u00a0or\u00a0otherwise\u00a0 discriminate\u00a0against\u00a0an\u00a0individual\u00a0with\u00a0respect\u00a0to\u00a0employment,\u00a0compensation,\u00a0or\u00a0a\u00a0term,\u00a0condition,\u00a0or\u00a0 privilege\u00a0of\u00a0employment,\u00a0because\u00a0of\u00a0religion,\u00a0race,\u00a0color,\u00a0national\u00a0origin,\u00a0age,\u00a0sex,\u00a0height,\u00a0weight,\u00a0or\u00a0 marital\u00a0status.<\/p>\n<p>So,\u00a0under\u00a0Michigan\u00a0law\u00a0Smith\u00a0and\u00a0Convery\u00a0may\u00a0have\u00a0a\u00a0case\u00a0for\u00a0weight\u00a0discrimination.\u00a0\u00a0That\u00a0is,\u00a0under\u00a0 Michigan\u00a0law,\u00a0weight\u00a0is\u00a0a\u00a0non\u2010job\u2010related\u00a0criterion.\u00a0\u00a0Smith\u00a0and\u00a0Convery\u2019s\u00a0attorney\u00a0put\u00a0it\u00a0this\u00a0way,\u00a0\u201cAll\u00a0 their\u00a0job\u00a0duties\u00a0are\u00a0those\u00a0of\u00a0a\u00a0waitress.\u00a0\u00a0Serve\u00a0chicken\u00a0wings,\u00a0refill\u00a0salt\u00a0shakers,\u00a0carry\u00a0mugs\u00a0of\u00a0beer.\u201d\u00a0\u00a0In\u00a0 other\u00a0words,\u00a0weight\u00a0isn\u2019t\u00a0related\u00a0to\u00a0how\u00a0well\u00a0Smith\u00a0and\u00a0Convery\u00a0do\u00a0their\u00a0jobs\u00a0at\u00a0Hooters.\u00a0\u00a0So\u00a0from\u00a0the\u00a0 plaintiffs\u2019\u00a0perspective,\u00a0under\u00a0Michigan\u00a0law,\u00a0weight\u00a0clearly\u00a0should\u00a0not\u00a0be\u00a0a\u00a0factor\u00a0in\u00a0human\u00a0resource\u00a0 decisions.<\/p>\n<p>In\u00a0Chapter\u00a011\u00a0on\u00a0human\u00a0resource\u00a0management,\u00a0the\u00a0general\u00a0effect\u00a0of\u00a0Federal\u00a0employment\u00a0law,\u00a0which\u00a0is\u00a0 still\u00a0evolving\u00a0through\u00a0court\u00a0decisions,\u00a0is\u00a0that\u00a0employers\u00a0may\u00a0not\u00a0discriminate\u00a0in\u00a0employment\u00a0decisions\u00a0 on\u00a0the\u00a0basis\u00a0of\u00a0sex,\u00a0age,\u00a0religion,\u00a0color,\u00a0national\u00a0origin,\u00a0race,\u00a0or\u00a0disability.\u00a0The\u00a0intent\u00a0is\u00a0to\u00a0make\u00a0these\u00a0 factors\u00a0irrelevant\u00a0in\u00a0employment\u00a0decisions.\u00a0Stated\u00a0another\u00a0way,\u00a0employment\u00a0decisions\u00a0should\u00a0be\u00a0based\u00a0 on\u00a0factors\u00a0that\u00a0are\u00a0\u201cjob\u00a0related,\u201d\u00a0\u201creasonably\u00a0necessary,\u201d\u00a0or\u00a0a\u00a0\u201cbusiness\u00a0necessity\u201d\u00a0for\u00a0successful\u00a0job\u00a0 performance.<\/p>\n<p>The\u00a0only\u00a0time\u00a0that\u00a0sex,\u00a0age,\u00a0religion,\u00a0and\u00a0the\u00a0like\u00a0can\u00a0be\u00a0used\u00a0to\u00a0make\u00a0employment\u00a0decisions\u00a0is\u00a0when\u00a0 they\u00a0are\u00a0considered\u00a0a\u00a0bona\u00a0fide\u00a0occupational\u00a0qualification(BFOQ).\u00a0\u00a0Title\u00a0VII\u00a0of\u00a0the\u00a01964\u00a0Civil\u00a0Rights\u00a0Act\u00a0 says\u00a0that\u00a0it\u00a0is\u00a0not\u00a0unlawful\u00a0to\u00a0hire\u00a0and\u00a0employ\u00a0someone\u00a0on\u00a0the\u00a0basis\u00a0of\u00a0sex,\u00a0religion,\u00a0or\u00a0national\u00a0origin\u00a0 when\u00a0there\u00a0is\u00a0a\u00a0bona\u00a0fide\u00a0occupational\u00a0qualification\u00a0(BFOQ)\u00a0that\u00a0is\u00a0\u201creasonably\u00a0necessary\u00a0to\u00a0the\u00a0normal\u00a0 operation\u00a0of\u00a0that\u00a0particular\u00a0business.\u201d<\/p>\n<p>For\u00a0example,\u00a0a\u00a0Baptist\u00a0church\u00a0hiring\u00a0a\u00a0new\u00a0minister\u00a0can\u00a0reasonably\u00a0specify\u00a0that\u00a0being\u00a0a\u00a0Baptist\u00a0rather\u00a0 than\u00a0a\u00a0Catholic\u00a0or\u00a0Presbyterian\u00a0is\u00a0a\u00a0BFOQ\u00a0for\u00a0the\u00a0position.\u00a0However,\u00a0it\u2019s\u00a0unlikely\u00a0that\u00a0the\u00a0church\u00a0could\u00a0specify race or national origin as a BFOQ.
