What are the elements that must be proven to prevail on a claim of Insider Trading under<br \/>\nthe Securities and Exchange Acts?<br \/>\n2. What challenges do you see in proving a claim for Insider Trading?<br \/>\n3. What are the elements of a violation under the Stark Law prohibiting certain patient<br \/>\nreferrals by physicians?<br \/>\n4. What are the elements of a violation under the Anti-kickback Statute applying to<br \/>\nPhysicians under The Medicare and Medicaid Patient Protection Act of 1987.<br \/>\n5. What is the practical impact of strict liability as it relates to proving a violation? (I.e. \u0080\u0093 how<br \/>\ndoes the requirement for making a case differ from ordinary fraud type liability?)<br \/>\n6. What are the prerequisites for certification of a class (as in Class-Action status) under the<br \/>\nFederal system?
