The reason for the lateness is that I was not well, therefore I could not write to you earlier. However, I would like to note and clarify the following;<\/p>\n<ol>\n<li>first, it seems that you forgot to inform me when to come and collect the original statement which is in your possession. Concerning the statement, it is important to note that, it requires some correction and that you are kindly advised not to take any information or make any notes from it.A copy of this statement was sent to you by email on 23 July, attached with a letter, which you confirmed as received in your office on 26 July.<\/li>\n<li>Secondly, it is important to take note that you were paid \u00a3 as agreed in our contract. Since you did not start the job which you were instructed and which you agree to do, the remaining amount was not paid.<\/li>\n<li>Regarding my recordings, it is also important to note that it\u2019s not something to make you feel embarrassed. Unfortunately, I regret that I did let you know that I will be recording.\u00a0\u00a0\u00a0I understand that you agreed with the recording, and you never raised any\u00a0issue concerning the recordings. Mostly,I use records\u00a0for my personal\u00a0reasons only,\u00a0while respecting my client\u2019s privacytoanalyzewhatwas\u00a0agreed\u00a0or promised\u00a0by clients during our meetings.\u00a0The records are only meant to be used as evidence\u00a0in case of violation of the terms of contract or act of negligence.\u00a0Furthermore,we are aware that you are\u00a0too using\u00a0several recording devices in your office which is acceptableand normal inthis current\u00a0digital era.Therefore, all sorts of recording for all kinds of reasons are normal and legal.<\/li>\n<li>I have to be very\u00a0clear that\u00a0asking the complaint procedure is not threatening\u00a0atall,and this is what was\u00a0agreed in our contract\u2019sterms, therefore you should not take it as a big issue when I am requesting it. To clarify it further, I have requested the complaint procedure after failure to replay to several emails. Additionally, at some point, I felt that you were ignorant\/reluctant to my instructions to draft a letter and request a complaint procedure which was the\u00a0right action in this circumstance.<\/li>\n<li>As you know, we agreed that you will take my instructions and make an application for disclosure\u00a0ofdocuments that you failed even after making several reminders. Besides you were instructed to request my documents from\u00a0Ersan&amp;Co\u00a0\u00a0\u00a0which you also failed regardless of several requests.<\/li>\n<\/ol>\n<p>6.As you explained to me earlier, you spent an enormous amount of time preparing chronology which according to the terms of the contractwas not part of what you were instructed to arrange.Though you made efforts, your chronology\u00a0was\u00a0incomplete\u00a0and a lot of crucialfacts were missing while some facts did not come from my case. Based on my understanding, this happened because\u00a0you prepared chronology without having the a full file of papers\/information and the fact that you negligentlyrejected my instructions\u00a0to draft a letter and get the full file of documents.\u00a0It is important to note that the chronology could only be complete and useful after we received\u00a0responds and files from Ersan&amp;Co. Therefore,this means you\u00a0might have wasted\u00a0a lot of time for no reason.Based on the nature of the contract, I do not, therefore, bear any responsibility including financial for your\u00a0ignorance\u00a0to take my instructions. With this letter, I\u00a0have attached copies of the handwritten professional report, Ersan&amp;Co\u00a0letterwhich confirms that they never received any original statement from the previous solicitor and that you negligently prepared my case without having original documents.\u00a0Attached also is Mr. Pove\u2019s statement to the police which was given soon after the accident happened, where he clearly described how the accident happened.Regardless of Mr. Povebeing independent, it is important to note that this evidence was supposed to be in your chronology and be the main point to\u00a0start\u00a0my case.<\/p>\n<ol start=\"7\">\n<li>More than once\u00a0I\u00a0approached you with\u00a0the\u00a0following\u00a0points\u00a0instructed you to start my case;<\/li>\n<li>Two\u00a0handwritten professional reports\u00a0whichconfirmed\u00a0that signatures on the\u00a0witnessstatements\u00a0were\u00a0forged. Additionally, details in the\u00a0forged statement were inconsistent\u00a0therefore\u00a0causing me to lose my case,<\/li>\n<li>Ersan&amp;Co\u00a0lodged documents to the court without having\u00a0originals which you knew very well that it isa severe breach of Civil Procedures Rules,<\/li>\n<li>Ercan&amp;co\u00a0negligently prepared my case including very important facts which\u00a0theylodged\u00a0during my case at the County Court. In contrast, this information as you are aware should be lodged at the High Court and this is again\u00a0a very severe breach of\u00a0CPR and injustice to me.<\/li>\n<li>Ersan&amp;Co\u00a0failedto\u00a0lodge all the available\u00a0evidencewhich they\u00a0legally have a duty to ensure they act in the best interest\u00a0of their client.<\/li>\n<li>Ersan&amp;co\u00a0rejected my request to appeal when they very well knew\u00a0howfailed me and how their fraudulent statements\u00a0causedinconvenience to me during the trial.<\/li>\n<li>Lastly, Ersan&amp;Co\u00a0failed to avail to the hearing very important witness\u00a0whosaw how the accident occurred which to me I feel is an injustice.<\/li>\n<\/ol>\n<p>Mr. Lewis, you demonstrably rejected\u00a0to take instructions\u00a0and\u00a0start\u00a0my case. Therefore, I would request you to immediately explain to me your\u00a0reasons for\u00a0your delay. To prove your negligence and the prolonged delay, I have attached all the emails that you failed to reply\u00a0and I am looking forward to your response as soon as possible.<\/p>\n<p>It is my wish to see these issues resolved as soon as possible, therefore, kindly feel free to reach me out so that I might understand your situation and be of assistance.<\/p>\n<p>Thank You for your time and I am waiting for your response.
